1. General Provisions

1.1 These Terms of Service (hereinafter referred to as the "Agreement") govern the relationship between the owner and operator of TRON DISCOUNT (hereinafter the "Platform," "we," "us," or "our") and any individual or entity (hereinafter "User" or "you") who accesses or uses the services provided via this Platform.

1.2 By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree with any part of these Terms, you must immediately discontinue using the Platform.

1.3 The Platform provides services related to buying and selling "energy" (a Tron-based resource) and additional functionalities on the Tron blockchain. We are not a financial institution, bank, broker, dealer, or investment advisor. All actions performed on or through the Platform are at the User's sole risk.

1.4 The Platform reserves the right to modify or replace any part of this Agreement at any time. The updated version shall become effective upon posting on our website unless otherwise stated. Continued use of the Platform following such changes constitutes acceptance of those changes.

2. Use of the Platform

2.1 The User bears full responsibility for ensuring that accessing and using the Platform's services is lawful in their jurisdiction. We assume no responsibility for the User's non-compliance with local laws or regulations.

2.2 Access to certain Platform features may require third-party applications (e.g., TronLink). We disclaim any liability for the availability, security, or correct functioning of such external software or services.

2.3 Any operations with cryptoassets, including TRX, Energy, or Bandwidth, carry significant risks (price volatility, technical failures, loss of private keys, etc.). The User acknowledges that all financial and other consequences of such transactions are borne solely by them.

2.4 We do not guarantee continuous availability or uninterrupted operation of the Platform. Downtime or disruptions may occur due to maintenance, network issues, force majeure, or other factors beyond our control.

3. Disclaimer of Warranties

3.1 The Platform is provided on an "as is" and "as available" basis. We make no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, security, or non-infringement.

3.2 We do not warrant that:

  • (a) The Platform will meet your requirements or expectations;
  • (b) The results or outputs obtained from using the Platform will be accurate or reliable;
  • (c) Any errors or defects in the Platform's operation or materials will be corrected.

3.3 We assume no liability for any losses resulting from third-party actions, technical failures, hacking, or any events beyond our control.

4. Limitation of Liability

4.1 Under no circumstances shall the Platform, its owners, employees, partners, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages, or for any damages related to lost profits, even if advised of the possibility of such damages.

4.2 The aggregate liability of the Platform to the User for any claims arising out of or in connection with the use of the Platform shall not exceed the amount directly paid by the User to the Platform within the last six (6) months. If no direct payments have been made, the Platform's liability is zero.

4.3 The User acknowledges that blockchain transactions are generally irreversible, and any incorrectly entered addresses or errors when sending digital assets are the sole responsibility of the User. We are not liable for mistakes in input data.

5. Indemnification

5.1 You agree to defend, indemnify, and hold harmless the Platform (including its owners, directors, employees, and agents) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • (a) Your breach of this Agreement;
  • (b) Your violation of any applicable law or regulation;
  • (c) Your infringement of any rights of a third party or misuse of the Platform.

6. Intellectual Property

6.1 All rights to the content published on the Platform's website (including text, graphics, logos, and other materials) belong to their respective owners. Any unauthorized use of such materials without prior written consent is strictly prohibited.

6.2 Product names, service names, trademarks, and logos referenced on the Platform may be the property of their respective owners. Reference does not imply affiliation or endorsement.

7. Changes or Termination

7.1 We reserve the right to change, suspend, or discontinue (temporarily or permanently) any part of the Platform or its services at any time without prior notice.

7.2 We shall not be liable to the User or any third party for modifications, suspension, or termination of the Platform's operations.

8. Governing Law and Dispute Resolution

8.1 This Agreement shall be governed by and construed in accordance with principles of private international law and any applicable legal standards. We do not guarantee compliance with the laws of any specific jurisdiction.

8.2 All disputes arising out of or related to this Agreement shall be resolved through good-faith negotiations. If negotiations fail, the dispute shall be submitted to a competent court or arbitral tribunal chosen at our sole discretion.

8.3 Nothing in this Agreement limits our right to seek injunctive or any other relief in any competent court or jurisdiction for the protection of our intellectual property or other rights.

9. Miscellaneous

9.1 If any provision of this Agreement is found to be invalid or unenforceable under any applicable law, the remaining provisions shall remain in effect.

9.2 No right or obligation under this Agreement may be assigned or transferred to any third party without our prior written consent.

9.3 Any waiver of any provision or right by us shall not be deemed a continuing waiver and shall not preclude us from enforcing that provision in the future.

9.4 This Agreement, together with any referenced policies, constitutes the entire agreement between you and the Platform regarding its subject matter.
